Zionsville Town Council Rejects CarDon Project

According to the Zionsville Times Sentinel, the Zionsville Town Council voted 4-1 on March 3rd to reject zoning changes to allow a senior living facility proposed by CarDon & Associates for the corner of 850 E and Oak Street west of Zionsville.

An interesting corollary to this whole issue is the role a letter by State Senator Mike Delph played in the process (see the Zionsville Times Sentinel article and also this article in the Indiana Business Journal). Delph’s letter apparently ruffled some feathers and was the subject of discussion along with and associated with the CarDon zoning request. Make of this what you will…

SB 436 Passed by Senate

SB 436 was passed by the Indiana State Senate on 2/24/2015 on a 49-1 vote. It now heads to the House for a vote. Ironically, Sen. Delph (who authored two competing Senate bills with language which specifically prevented county assessors from reclassifying “ag” land as “excess residential”; I am going to contact him asking for an explanation of why he voted of favor of SB 436).

Senator Delph Introduces Zoning Legislation

I just learned that Sen. Delph has introduced two bills addressing the situation with “agricultural” land being reclassified as “excess residential”. Both of these bills appear to better solve this situation than SB 436.

Zionsville Plan Commission Votes Down CarDon Development

At a Feb. 17th meeting of the Zionsville Plan Commission, a request for a zoning change to 25 acres of property on the south-east corner of Oak Street and 850 E by CarDon & Associates for the purpose of constructing a senior living facility was denied. The commission vote was 4-2 against the proposed zoning change. More information is available in an article at Current in Zionsville.

Senate Bill 436 Committee Hearing

Senate Bill 436 is scheduled for a Tax & Fiscal Policy committee hearing on Tuesday, February 17th sometime after 8:30 AM in Room 431 of the Senate offices.  As you may recall, SB 436 is an alternate state and local taxation bill that apparently is intended to replace SB 405. Unfortunately, SB 436 does not appear to directly address the situation of property being reclassified from “agricultural” to “excess residential” in any way besides “recommending” that a committee be formed to address the issue “sometime” in 2015.
